This Acceptable Use Policy (“Policy”) defines the rules and restrictions governing the use of Vouch-Lab’s website, vouchers, and Services. By purchasing or using our Services, you (“User”) agree to comply with this Policy, which supplements the Terms & Conditions and Privacy Policy of Vouch-Lab.

Clause 1 – General Obligations of Lawful Use

1.1 The User undertakes to use the Site and Services exclusively for lawful, ethical, and legitimate business purposes, in compliance with applicable laws and regulations in Hong Kong and in their country of residence.
1.2 The Services may not be used for fraudulent activities, misrepresentation, or for any conduct that infringes intellectual property rights, privacy rights, or public order.
1.3 Any attempt to bypass security features, manipulate voucher pricing, or access unauthorised systems constitutes a breach of this Policy and may lead to immediate termination and legal action.
1.4 The User is solely responsible for the content, campaigns, or projects developed using the Services, and must ensure they do not violate consumer protection, advertising standards, or unfair competition laws.

Clause 2 – Prohibited Content and Activities

2.1 The User shall not use Vouch-Lab’s Services to create, promote, or distribute content that is illegal, defamatory, obscene, discriminatory, hateful, or otherwise harmful. This includes but is not limited to:

  • Incitement to violence, terrorism, or hate speech;
  • Pornographic or sexually explicit content;
  • Promotion of gambling, pyramid schemes, or fraudulent investment opportunities without explicit authorisation;
  • Misleading advertising or false claims likely to deceive consumers.
    2.2 The Services must not be used to support activities that violate sanctions, export restrictions, or applicable anti-bribery and anti-corruption laws.
    2.3 The Publisher reserves the right to block, remove, or refuse any project, campaign, or deliverable that violates this Policy, without liability for refunds or damages.

Clause 3 – Anti-Money Laundering (AML) and Counter-Terrorist Financing (CFT) Compliance

3.1 Vouch-Lab strictly prohibits the use of its Site or Services for any activity directly or indirectly linked to money laundering, terrorist financing, tax evasion, or financial crime. The User expressly undertakes not to use vouchers or purchased Services for concealing the origin of funds, transferring illicit proceeds, or facilitating unlawful financial flows.
3.2 The Publisher reserves the right to conduct Know Your Customer (KYC) checks or request additional information from Users where required under applicable AML/CFT regulations. This may include identification documents, proof of address, or confirmation of the source of funds.
3.3 If suspicious activity is detected (e.g., unusual payment patterns, use of stolen cards, multiple accounts under false identities), the Publisher may suspend or cancel the Service, freeze pending refunds, and file reports with the competent financial intelligence unit or regulatory authority.
3.4 Users acknowledge that compliance with AML/CFT rules is a shared responsibility. Any breach of this clause constitutes grounds for immediate termination of access to the Site and Services, without compensation.

Clause 4 – Data Protection, Cybersecurity, and Responsible Use of Access Credentials

4.1 The User shall not attempt to access, copy, or interfere with the Site’s source code, databases, or hosting systems. Any form of hacking, phishing, injection of malicious code, or denial-of-service attack is strictly prohibited.
4.2 Users must ensure that the content, materials, and data they provide for the execution of Services do not contain viruses, malware, or any element likely to compromise the Publisher’s systems or third-party platforms used in the performance of Services.
4.3 Login credentials (username, password, API keys) provided by the Site or required for integration with third-party tools must be kept strictly confidential. Users are responsible for any unauthorised use of their accounts resulting from negligence in securing their access.
4.4 The Publisher implements industry-standard technical and organisational measures to secure User data. However, Users remain responsible for securing their own devices, networks, and internal systems. Any breach arising from negligence on the User’s side will not give rise to Publisher liability.

Clause 5 – Prohibition of Spam, Misuse of Marketing Tools, and E-Reputation Abuse

5.1 The Services offered by Vouch-Lab, including email campaigns, SEO, social media assets, and advertising strategies, must not be used for unsolicited bulk communications (“spam”), misleading promotions, or manipulative practices that artificially inflate engagement or visibility.
5.2 Users are strictly prohibited from employing Vouch-Lab deliverables to harass, deceive, or mislead consumers, competitors, or regulators. Examples include fake reviews, black-hat SEO, misleading claims, or unlawful comparative advertising.
5.3 The use of Vouch-Lab Services to damage the reputation of individuals, competitors, or third parties is expressly forbidden. Any project aiming at defamation, reputational sabotage, or dissemination of false information will be refused or terminated without refund.
5.4 The Publisher reserves the right to report abusive campaigns or Users engaging in spam or fraudulent activities to competent authorities, hosting providers, or relevant platforms (e.g., Google, Meta, LinkedIn).

Clause 6 – Misuse of Data, Artificial Intelligence, and Automation Tools

6.1 Users shall not exploit the Publisher’s Services or deliverables to collect, store, or process personal data in violation of data protection regulations such as GDPR, UK GDPR, or Hong Kong PDPO.
6.2 The integration of analytics, CRM, or automation workflows provided by Vouch-Lab must be used responsibly and exclusively for lawful purposes. Harvesting emails, scraping data, or building unauthorised databases is prohibited.
6.3 Users shall not modify, manipulate, or repackage Vouch-Lab’s outputs (e.g., design templates, content, or scripts) to create automated systems that breach intellectual property rights or are used for fraudulent commercial resale.
6.4 Any attempt to integrate Vouch-Lab deliverables into artificial intelligence models, automated decision-making systems, or machine learning databases without prior written consent is strictly prohibited. Such conduct constitutes an infringement of intellectual property rights and may lead to legal action.

Clause 7 – Prohibited Advertising Practices and Market Manipulation

7.1 Users may not use Vouch-Lab’s Services to design or disseminate advertising that violates applicable advertising standards, consumer protection laws, or platform policies (e.g., Google Ads, Meta Ads).
7.2 Strictly prohibited activities include:

  • False or exaggerated claims regarding product performance;
  • Omission of material information that would mislead consumers;
  • Creation of deceptive funnels, “get-rich-quick” schemes, or hidden subscription traps;
  • Manipulative tactics aimed at distorting competition, including click fraud, keyword hijacking, or artificially boosting rankings.
    7.3 Any use of our Services to promote illegal financial instruments, unlicensed crypto-assets, or high-risk products (gambling, weapons, adult content, counterfeit goods) is forbidden unless explicit regulatory approval and prior written consent are obtained.
    7.4 Violations of this clause entitle the Publisher to suspend or terminate Services immediately, notify affected advertising platforms, and retain all amounts paid without obligation to refund.

Clause 8 – User Cooperation and Transparency Obligations

8.1 The quality and legality of Services delivered depend on the User’s good faith cooperation. Users must provide accurate, complete, and lawful information when submitting briefs, content, or data necessary for Service execution.
8.2 Users must promptly supply creative materials, logos, access to analytics dashboards, and any required approvals, without concealment or misrepresentation. Failure to do so may delay delivery and does not justify refund claims.
8.3 The User is prohibited from instructing the Publisher to carry out tasks that conflict with laws, advertising guidelines, or platform rules. If such instructions are given, the Publisher reserves the right to refuse execution without liability.
8.4 Where regulatory declarations or disclaimers are required (e.g., financial promotions, health-related advertising), the User must provide them. The Publisher disclaims liability for omissions or false declarations made by the User.

Clause 9 – Sanctions, Suspension and Termination

9.1 Any violation of this Policy, whether intentional or resulting from negligence, entitles the Publisher to take corrective measures without prior notice. Such measures may include:

  • Temporary suspension of access to the Site or Services;
  • Immediate cancellation of ongoing vouchers or deliverables;
  • Refusal of future orders or account registration;
  • Retention of payments already received;
  • Legal action to recover damages caused.
    9.2 Where a breach involves unlawful activities (e.g., money laundering, financing of terrorism, fraud, data theft, reputational sabotage), the Publisher reserves the right to cooperate fully with competent authorities, regulatory bodies, and financial institutions by transmitting all relevant information.
    9.3 The Publisher is under no obligation to provide compensation, indemnification, or refund in cases where suspension or termination results from a User’s breach of this Policy.
    9.4 Suspension or termination under this clause shall not prejudice the Publisher’s right to claim additional damages or costs resulting from the breach.

Clause 10 – Final Provisions and Jurisdiction

10.1 This Acceptable Use Policy forms an integral part of the Terms & Conditions, the Supplementary Service Conditions, and the Refund & Cancellation Policy of Vouch-Lab. In the event of conflict, the Terms & Conditions shall prevail.
10.2 If any clause of this Policy is deemed invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
10.3 The Publisher reserves the right to amend or update this Policy at any time. Users are deemed to have accepted the latest version upon continuing to use the Site or Services after publication of the updated Policy.
10.4 This Policy is governed by and construed in accordance with the laws of Hong Kong. Any dispute relating to its interpretation or application shall fall under the exclusive jurisdiction of the courts of Hong Kong, without prejudice to mandatory consumer rights in other jurisdictions.
10.5 By purchasing vouchers, using the Site, or commissioning Services, the User acknowledges having read, understood, and accepted this Policy in its entirety.
